California Orthotic Device Exemptions

California – In the state of California, orthotic’s are regarded as “medicines pursuant.”  Purchased orthotic devices are not subject to tax as long as prescribed by a physician.  The prescription does not have to necessarily be filled by a pharmacist, as-long-as accompanied by a prescription. You may also order one from a clinic, physical therapist or a medical retailer as-long-as it is ordered by prescription.

Orthotics are exempt from sales taxes if the device is worn on the body as a brace, correction or support device.  Orthopedic shoes will not qualify for the exemption unless custom made for the patient, is part of a leg brace or an artificial leg.
