Texas Senate SB 379 “Tampon Tax”

TX: Texas shoppers no longer have to pay sales tax on menstrual products, making the state one of the few states in the country to have eliminated the “tampon tax.”

A new law that went into effect September 1, 2023, eliminates the sales tax on feminine hygiene items, including tampons, menstrual pads, and menstrual cups. In addition to menstrual products, S.B. 379 will eliminate sales tax on home care items, including diapers, bottles, baby wipes, maternity clothes, and pumping products.

Texas Republican state Sen. Joan Huffman, a sponsor of the new Texas law, described menstrual products as “essential” to women’s “health and well-being.”  “Every woman knows these products are not optional,” Huffman said last year. “They are essential to our health and well-being and should be tax exempt.”

Connie Moreno, founder of HERpantry, summed it up perfectly: “Many things are considered a luxury here, but they are not. They are necessary.” These are necessities, and no one should have to pay taxes on items as essential as hygiene products or baby diapers and wipes.
